Wrongful Death

In Missouri, special rules apply when somone is killed as a result of the negligence or intentional act of another.  There are classes of individuals who may seek recovery for the death of a loved one.  In the first class, the spouse, children of the deceased or parents of the deceased may bring a wrongful death suit.  If there are no members of the first class available to bring the suit, then the brothers or sisters of the deceased may do so.  Finally, if there are no members of either of those classes, the court can appoint a plaintiff ad litem to pursue the wrongful death claim.

In addition to determining who has priority in bringing a wrongul death action, Missouri statute defines what damage may be recovered.  It is possible to recover for hospital and medical bills for the deceased as well as funeral and burial expenses.  While those damages may be more easily determined, there are additional damages including the reasonable value of services, consortium, comfort, instruction, quidance, counsel, training and financial support lost from the deceased.  Some of these damages require the use of experts to determine their value.  The statute of limitations for a wrongful death action in the State of Missouri is three years from the date of death of the decedent.
